These Terms & Conditions govern your use of the Harvest Roots website and meal-delivery program. Please read them before applying or using our services.

1. Acceptance of terms

By visiting www.harvestrootsny.com (the “Site”), submitting an application, or receiving meals through Harvest Roots (the “Program”), you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site or apply for the Program. If you are applying on behalf of someone else — as a family member, caregiver, or referring case manager — you confirm that you have the authority to share their information with us for this purpose.

2. Who we are

Harvest Roots is a nonprofit organization that delivers free, ready-to-eat, nutritious meals to qualified clients across New York State. We can be reached at harvestrootsny@gmail.com or (845) 604-9607.

3. Eligibility & applications

Meals are provided at no cost to individuals who meet our published eligibility criteria (see our Who Qualifies page), which may include pregnancy, postpartum status, homelessness, a chronic disease, a mental health condition, transitioning out of institutional care, or enrollment in a NYS Health Home.

  • Submitting an application does not guarantee eligibility or enrollment in the Program.
  • We may request additional information to confirm eligibility before delivery begins.
  • You agree to provide accurate, current, and complete information. Providing false information may result in denial or discontinuation of services.
  • Eligibility criteria, service areas, and available capacity may change at any time without prior notice.

4. The meal program

Where enrolled, Harvest Roots will make reasonable efforts to deliver ready-to-eat meals on an agreed schedule. However:

  • Delivery schedules, meal availability, and menu contents may vary based on funding, supply, weather, and operational capacity.
  • We do not guarantee uninterrupted or indefinite service. The Program may be paused, modified, or discontinued for any client, region, or entirely, at our discretion.
  • You are responsible for providing an accurate delivery address and for being reasonably available to receive deliveries, or for designating someone who can.
  • If you have food allergies, intolerances, or specific dietary needs, you must disclose them during the application process. Harvest Roots will make reasonable accommodations where possible but cannot guarantee an allergen-free environment or facility.

5. Not medical advice

Harvest Roots is a food-delivery program, not a healthcare provider. Nothing on this Site, in our application, or in our meals constitutes medical, nutritional, or clinical advice, diagnosis, or treatment. Our meals are not designed to treat, cure, or manage any specific medical condition. Always consult a qualified physician, registered dietitian, or other licensed healthcare provider regarding your specific health needs, medical conditions, or dietary restrictions.

6. Your responsibilities

When using the Site or Program, you agree not to:

  • Provide false, misleading, or fraudulent information in an application;
  • Use the Site or Program for any unlawful purpose or in a way that could harm Harvest Roots, our staff, volunteers, or other clients;
  • Attempt to gain unauthorized access to any part of the Site, our systems, or another client’s data;
  • Resell, redistribute, or commercially exploit meals or services received through the Program.

7. Third-party services

Our online application is hosted by a third-party form provider (JotForm) on a HIPAA-compliant platform tier. Your use of that embedded form is also subject to that provider’s own terms of service and privacy policy. Harvest Roots is not responsible for the availability, security practices, or content of third-party websites or tools we link to or rely on, including social media platforms such as Instagram.

8. Intellectual property

The Harvest Roots name, logo, and the content, design, and graphics on this Site are the property of Harvest Roots or its licensors and are protected by applicable intellectual property laws. You may view and share Site content for personal, non-commercial purposes, but may not reproduce, modify, distribute, or create derivative works from our branding or content without prior written permission.

9. Limitation of liability

To the fullest extent permitted by law, Harvest Roots, its officers, employees, and volunteers will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, participation in the Program, or consumption of meals provided, including but not limited to allergic reactions where allergies were not properly disclosed, missed or delayed deliveries, or reliance on Site content in place of professional medical advice. The Site and Program are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied.

10. Indemnification

You agree to indemnify and hold harmless Harvest Roots and its officers, employees, and volunteers from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your violation of these Terms, misuse of the Program, or provision of false information in your application.

11. Suspending or ending services

We may suspend, discontinue, or decline to renew meal deliveries to any client at our discretion, including where eligibility can no longer be confirmed, where safety concerns arise, where program capacity is reached, or where these Terms have been violated. Where reasonably possible, we will attempt to notify you in advance.

12. Changes to these terms

We may update these Terms from time to time to reflect changes in our Program, legal requirements, or operations. The “Last updated” date at the top of this page will reflect the most recent revision. Continued use of the Site or Program after changes are posted constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles, and any disputes will be subject to the exclusive jurisdiction of the state or federal courts located in New York State.
